1.- Registration details and general information

The main mission of Julià is to provide a quality service with a clear vocation to assist citizens, and thus contribute to quality urban mobility, and to provide a benchmark for passenger transport in terms of how it manages its lines and optimises its resources

This website (the “Website”) was created primarily to offer detailed and updated information on the services (the “Content” and/or “Services”) specific to Julià and to provide citizens access to the websites and information of the Julià Group (“Julià Group”), so they can access the services offered in each of them. The Julià Group is a group of companies with various lines of business, and it is present in Andorra, Argentina, Mexico, the USA, Puerto Rico, the United Kingdom, the United Arab Emirates and Morocco.

This legal notice (“Legal Notice”), together with the privacy policy (“Privacy Policy”) and cookie policy (“Cookie Policy”), constitute the applicable legal framework (jointly “Legal Terms”) that regulates the terms of use of the Website.

The use of the Website attributes to anyone who uses it the status of User (“User”) and expressly and fully implies the acceptance of the Legal Terms. The User undertakes to use the Website in accordance with the Legal Terms and the applicable legal regulations at the time of use.

The Legal Terms are updated periodically, meaning those that are in force and published at the time of use of the Website shall apply. The User must carefully read these texts before browsing the website, and periodically thereafter. If you do not agree with these Legal Terms, you must not use the Website.

If any service offered on the Website is subject to specific conditions that supplement those contained in this Legal Notice, the User will be informed and must read and accept them.

2.- Intellectual property

The intellectual property rights of the Website, its source code, design, navigation structure, databases and the different elements it contains are the property of Julià. It is therefore the exclusive owner of the operating rights in any form and, in particular, the rights of reproduction, distribution, public communication and transformation.

The information provided on the website is the property of Julià and its authors, and is regarded as a protected work under the provisions of Royal Decree 1/1996 of 12 April, which approves the revised text of the Intellectual Property Act. The international treaties in this regard are also applicable to the website.

This Legal Notice does not grant any rights to the User in relation to any of the elements that make up the Website, the Content or personal Services. Therefore, the copying, public disclosure, distribution, marketing or any other activity with a public purpose or use that can be carried out with the content of the website is prohibited.

The trademarks, trade names and distinctive signs of any kind appearing on the website are the property of Julià, or have been published with the consent of their legitimate owners. Access to the Website shall not be understood to confer any right to Users involving the aforementioned brands, trade names and/or distinctive signs.

To make any type of comment regarding possible breaches of intellectual or industrial property rights, or about any of the Website Content, Users can contact Julià by email at RDGP@julia.net  and attaching the relevant information. In any case, Julià assumes no responsibility whatsoever for the intellectual or industrial property rights of third parties that are violated by Users of the Website or by any other person outside Julià.

3.- Access and conditions of use of the Website

Any unauthorised use is prohibited without the prior written consent of Julià; Julià reserves the right to refuse, suspend, interrupt or cancel access to or use of the Website, in whole or in part, to Users who do not comply with any of the conditions provided for in this Legal Notice and/or any of the Website’s Legal Terms.

Users are not required to subscribe or register beforehand to use the Website Services, which are free of charge. In any case, there are Services, such as requesting information for subsequent formalisation of a service provision, that require filling in the contact forms and registering on the Website. This registration will be done in the manner expressly indicated in the Service, and the data will be processed as per the provisions of the Website’s Privacy Policy.

In an effort to enforce at all times the principles governing the applicable laws on personal data protection, Julià only gathers the minimum information necessary to offer the Website Services, and guarantees at all times the appropriate measures to ensure the security and integrity required by law for each file type.

All the personal information and data that Users provide in the forms when signing up for the Services must be their own and true. Users shall be solely responsible for any false or inaccurate statements made and for any damages caused to Julià or third parties for the information they provide.

Julià will process the data as per the applicable laws, guaranteeing the confidentiality and exercise of the rights of Users subscribed to each Service.

Julià reserves the right to refuse, suspend, interrupt or cancel access to or use of the Website, in whole or in part, to Users who do not comply with any of the conditions provided for in this Legal Notice and/or any of the Legal Terms.

Furthermore, Julià will have the right to investigate and report any of the aforementioned conduct in accordance with the Law, and to collaborate with the authorities in the investigation of these actions.

4.- Minors

The Website is not intended for minors. To use these Services, minors must obtain permission from their parents, guardians or legal representatives, who shall be responsible for all acts carried out by minors under their care.

The adults in charge of the minors bear full responsibility for determining the specific Content and Services that said minors can access. As internet allows access to content that may not be appropriate for minors, Users are notified of the existence of mechanisms, specifically computer programs for filtering and blocking, which make it possible to limit the content available and, while these programs are not infallible, they are especially useful for controlling and restricting the material accessible by minors.

5.- Use of the Content and Services

Julià makes available to Users the Content and Services located on the Website.

If the information is from external sources, the source, medium or any other information relating to its origin shall be provided.

The User undertakes to use the Services and the information provided on the Website in accordance with the law, the Legal Terms, the specific conditions, the rules of conduct involving public decency and order, and always for the purposes for which they were created. 

Julià takes no responsibility for any misuse of the Website’s Content and Services, which is the sole responsibility of the person who accesses or uses them, as reflected in Section 9 herein.

Julià also assumes no responsibility for the information contained on the third-party websites that can be accessed via links on the Website: staging.grupojulia.com. These links are provided for information purposes, and do not constitute an endorsement to purchase the products or services that may be offered on the website linked. If Julià has effective knowledge that the activity or information linked is unlawful, constitutes an offence, or may harm the property or rights of third parties in a way that may be subject to compensation, it shall act with the necessary diligence to delete or disable the corresponding link as soon as possible.

6.- Obligations of Website Users

Users undertake to use the Website, its Services and Content in accordance with the law, the Legal Terms, the specific conditions, the rules of conduct involving public decency and order, and always for the purposes for which they were created. 

Users shall refrain from using any of the Services for unlawful, prohibited or unauthorised purposes, or in a way that damages the rights and interests of third parties; or that may damage, disable, overload, impair or prevent the normal use of the Website, Services, computer equipment, documents, files and other Content offered by Julià on the Website, and/or that may be stored on any computer equipment of Julià, of other Users or any Internet User (both hardware and software).  

In particular, and without limitation, Users undertake:

  1. Not to engage in illegal or illicit activities, or those that are contrary to good faith and public order;
  2. Not to cause damage to the physical and software systems of the Website, its suppliers or third parties;
  3. Not to introduce or disseminate computer viruses or any other physical or software systems that may cause damage to networks, equipment, user systems, the website or Julià;
  4. Not to attempt to access, use and/or manipulate data of Julià, third-party vendors and/or other Users;
  5. Not to suppress, alter, bypass or manipulate any protective device or security systems that may be installed on the Website;
  6. Not to delete, manipulate or in any way alter any reservation of rights and other identifying data;
  7. Not to use robots, data scanning or storage systems (such as spiders or scrapers), hidden links or any other resource, tool, program, algorithm or method of automatic data collection/extraction to access, acquire, copy or monitor the Website, without the express written permission of Julià.
  8. Not to use the services and, in particular, information of any kind obtained through the Website to send advertising, communications for direct sale or for any other kind of commercial purpose, unsolicited messages aimed at groups of people regardless of their purpose, or to market or disclose said information in any way.
  9. Not to impersonate another person or organisation, use offensive or disrespectful language such as insults, threats or comments that may harm the sensitivity of other Users; or to present, recommend and/or cite companies or websites and/or engage in marketing or spam actions. This type of content will be deleted together with, where applicable, the accounts that carried out said actions.
  10. Not to decompile, disassemble, reverse engineer, sublicence or transmit in any way, translate or carry out works derived from the computer programs needed to operate, access and use the Website and the Services contained therein, or to carry out, with regard to any or part of the programs, any of the exploits described in the previous paragraph. Users of the Website must refrain from deleting, altering, bypassing or manipulating any protective device or security system that may be installed on the Website.

Julià reserves the right to remove any content that is disrespectful and/or in violation of the provisions of the Legal Terms, as well as to take any appropriate legal actions.

Similarly, Users undertake to use the Content made available to them on the Website, including but not limited to, any text, photographs, graphics, files, logos, images, icons, technology, software and links; as well as the selection and presentation of the materials included in it and other audiovisual or sound content, its software, graphic design and the source codes needed for its operation, access and use, in accordance with the law and the Legal Terms of the Website; and in particular, they shall refrain from:

  1. Reproducing, copying, distributing, making available or otherwise publicly communicating, transforming or modifying, or engaging in any other form of exploitation, using any means, of all or part of the Content, as well as of their design, selection and presentation, without the express authorisation of [*] or the holder of the corresponding rights, or unless that is legally permitted;
  2. Decompiling, disassembling, reverse engineering, sublicencing or transmitting in any way, translating or carrying out works derived from the computer programs needed to operate, access and use the Website and the Services contained therein, or from carrying out, with regard to any or part of the programs, any of the exploits described in the previous paragraph. Users of the Website must refrain at all times from suppressing, altering, bypassing or manipulating any protective device or security systems that may be installed on the Website.
  3. Deleting, manipulating or in any way altering any reservation of rights and other identifying data;

7.- Permitted uses

Users are allowed to view, print out and download part of the website only if the following conditions are met:

  1. These uses are compatible with the purposes of the Website.
  2. It is done only to obtain information for personal and private use. Its use for commercial purposes or for distribution, public communication, transformation or decompilation is expressly prohibited.
  3. None of the Content related to the Website is modified in any way.
  4. No graphics, icons or images of the Website are used, copied or distributed separately from the text or the rest of the images that accompany it.

Julià reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on the Website, the configuration and presentation thereof and the terms of access; as well as the right to modify at any time the Legal Terms that, in relation to the Website, have been made available or may be made available to Users of the Website.

9.- Responsibilities

A. Disclaimer for the Services and Content of the Website

Julià does not guarantee the absence of viruses, worms or other harmful software elements that could cause damage to or alter the computer system, electronic documents or files of Users of the Website. Consequently, Julià accepts no liability for any damages that such elements may cause to Users. 

Users shall be liable for damages of any kind that Julià may suffer as a result of breaching any of the obligations to which they are subject by virtue of these Legal Terms of the Website. Users are aware of and voluntarily accept that they are solely and exclusively responsible for their use of any Service or Content of this Website, and must provide any information that is requested in a timely manner, in keeping with the guidelines and instructions of the Website.

Julià will not be responsible for the Users’ failure to comply with the terms and conditions of this Legal Notice, or for the use of the Services and Content accessible from the Website. Any damages that may be caused by a User impersonating a third party in any communication made through the Website shall be the responsibility of the person who made it, since Julià does not verify the authenticity of the content or information provided by Users of the Website.

The website may provide access to both its own content and information and content supplied by third parties. In the latter case, Julià does not control this content or guarantee the absence of viruses when downloading the information; as a result, Julià will not be liable for any damages that may occur in this case.

The website also offers Users link resources (hyperlinks, banners, buttons, etc.) and tools that allow searches to be done and to access different websites managed by a third party (“Linked Sites”). Julià does not control, recommend or supply the information and services that may be stored on these websites; therefore, Users who access them must be careful when evaluating and using the information, content and services contained on these linked sites. Julià accepts no liability for any damages that may be caused by:

  1. The operation, availability, accessibility or continuity of the Linked Sites.
  2. The maintenance of the information, content or services present on Linked Sites.
  3. The provision or transmission of information, content or services present on Linked Sites.
  4. The quality, legality or reliability of the content and services present on Linked Sites.
  5. Non-compliance with the law, morals and decency as a result of the dissemination, storage and availability of the content supplied by third parties.
  6. Violation of intellectual or industrial property rights, rights to honour, personal and family privacy, to the image of people or the disclosure of personal information by third parties.
  7. Engaging in unfair competition or unlawful advertising.
  8. The lack of veracity, accuracy or timeliness of the Content.

Julià will not be responsible for the Users’ failure to comply with the terms and conditions of this Legal Notice, or for the use of the Services and Content accessible from the Website. Any damages that may be caused by a User impersonating a third party in any communication made through the Website shall be the responsibility of the person who made it, since Julià does not verify the authenticity of the content or information provided by Users of the Website.

The introduction of hyperlinks for commercial purposes in websites outside Julià’s control that allow access to the Website without Julià’s authorisation is expressly forbidden. The existence of this type of link shall not imply the existence of a commercial relationship with the owner of the website containing the hyperlink, nor Julià’s endorsement thereof.

B. Disclaimer for the operation of the Website

Julià does not guarantee that there will not be interruptions or errors accessing the Website or its Content and/or Services, or that it will be up to date. When reasonably possible, Julià will provide advance notice of any interruptions in the operation of the Website. Julià will do everything necessary to correct errors, reset communications and update the Content, whenever possible if the tasks are not difficult to perform, as soon as it becomes aware of the errors, disconnections or outdated Content.

Julià shall not be liable for any faults, service errors or network connection problems by the internet service provider chosen by the User.

Users of the Website are responsible for having adequate tools to detect and remove any harmful or damaging computer programs.

C. Disclaimer for the use of the Website

Users are solely responsible for accessing the Website and any unauthorised use of the information contained therein. Julià shall not be liable for any consequences, harm or damages that may arise from said access or use.

Julià accepts no liability for any errors or omissions that may affect the Website Contents or other content that may be accessible through the Website; as well as for any damage resulting from using the Website and/or any action taken on the basis of the information provided therein, including the presence of viruses or other elements that may cause alterations to computer systems. Julià shall also not be liable for any use of the Website and/or its Content that is made by other Users, or for any errors or omissions of third parties, regardless of whether these third parties are linked to Julià through a contractual relationship.

Julià takes no responsibility for any security errors that may occur, or for any damage that may be caused to the User’s computer system (hardware or software), or to the files or documents stored, as a result of:

  1. The presence of viruses on the computer used by the User to connect to the Services and Content of the Website.
  2. The improper operation of the browser or the use of outdated versions. Users undertake to use the website, its Content and Services in accordance with the law and with this Legal Notice. Users shall refrain at all times from using any of the information of Services for unlawful or prohibited purposes, or in a way that damages the interests of third parties.

10.- Prohibited uses

Any unauthorised use is prohibited without the prior written consent of Julià.

The unauthorised use of the information contained on the Website, its resale, or the violation of Julià’s intellectual property rights shall give rise to the relevant legal liabilities.

Any other use of the Website’s content through unauthorised third parties is prohibited.

11.- Data protection

In keeping with the provisions of the current Data Protection regulations, all personal data provided during the use of the Website shall be processed in accordance with the provisions of our Privacy Policy, which all Users read and accept when they visit the Website.

12.- Applicable legislation

This Legal Notice is governed by the following agreement. The Parties agree that any litigation, dispute, question or claim resulting from the performance or interpretation of this Legal Notice or related thereto, directly or indirectly, shall be resolved by arbitration by the Court of Arbitration of the Barcelona Bar Association, which is entrusted with arbitrating and designating the arbitrators, in accordance with its rules and statutes. The Parties also expressly state their commitment to comply with the arbitration decision issued. The arbitration ruling shall be final and binding on the Parties, which shall accept it with no conditions.

If necessary and when allowed by the applicable law, the Parties expressly waive any jurisdiction that may be applicable to them and submit to the authority of the Courts and Tribunals of Barcelona.

The above notwithstanding, both parties will do everything reasonably necessary to try to resolve any dispute in an amicable manner.

13.- Language

For Julià, Users are its priority, and it strives to communicate with them in their own language whenever possible. As a result, Julià has translated the Legal Terms of the Website into several languages. However, in the event of a conflict or question as to the meaning or scope of any section, term or expression contained therein, the Spanish version shall prevail, as it is the original version in which the Legal Terms of the Website were drafted.

14.- Out-of-court settlement of online conflicts

Moreover, if you believe that your rights have been violated, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013, Julià hereby informs you that you have the right to an alternative online consumer dispute resolution procedure.

The use of the online platform is not required or mandatory. Therefore, consumers are free to lodge their claims without using the platform beforehand.
